The History of Cuesports Foundation Limited

Cuesports Foundation Limited was formed with the aim of operating gaming machines in order to support various competitions and developmental programs around New Zealand.
As is the case in many things, over time it became apparent that while Cuesports Foundation Limited was indeed assisting developing players and upcoming talent, we were also in a position to assist other areas of the community.

The Cuesports Foundation’s Authorised Purpose is any:

  1. charitable purpose;
  2. non-commercial purpose that is beneficial to the whole or a section of the community; and
  3. purpose to assist with the promoting, controlling and conducting of race meetings under the Racing Act 2003, including the payment of stakes.
This shall include, but not be limited to:
Grants to amateur sports teams, clubs and organisations which are affiliated to a regional or national body and which compete in recognised leagues and tournaments to assist with:
  • the provision, maintenance and development of facilities and grounds, purchase of equipment, playing and training uniforms, trophies and modest tournament prizes (excluding cash prizes).
  • the provision of coaching, training and development programs.
  • actual and reasonable travel and accommodation expenses and entry fees for representatives participating in kindred groups (excludes payments to any team or player participating on a professional basis).
Grants to educational institutions to enable them to purchase equipment, books and educational aids and grants towards the construction of educational buildings not already covered by government funding.
The establishment of student scholarships, bursaries or grants to assist individual students to further their education provided such students are selected in a fair and open manner after public advertising.

Grants to recognised social service or welfare agencies to further the objectives of those groups.
All grants are limited to "not for profit" organisations within New Zealand.
No grant shall be made to any party which will result in a commercial advantage either directly or indirectly, to the member sites of Cuesports Foundation Limited.

When Cuesports Foundation Limited is in a situation where the funds available for distribution are less than the applications for funding received, the applications shall be dealt with in the following order/priority:
  1. Funding applications to assist with the promotion and development of amateur cue sports;
  2. Funding applications to assist with the promotion and development of amateur soccer;
  3. Funding applications to assist with the promotion and development of other amateur sports in New Zealand; and
  4. Educational grants and funding to assist non profit social service or welfare agencies in New Zealand.
So "amateur soccer" is high up on the priority funding list of Cuesports (NZ), interesting.

Grant Applications

Cuesports Foundation Limited invites sporting, charitable and non-profit community organisations to apply for a funding grant. Funds are available to be distributed from the Foundations’ Gaming Machine operations. Any grant issued will be for the promotion and development of community organisations that are established primarily for charitable, non commercial purposes that are beneficial to the whole or a section of the community.
Applications for grants close on the 10th of each month. Provided you have supplied all of the requested information and returned all receipts from previous Cuesports Foundation funding, we will have a response to you by the end of that month.

Cuesports Foundation - Grants Procedure:

Decision by Committee

This Policy was reviewed and approved as of 1st May 2010.

1. Applications for grants shall be considered by a Committee of the Cuesports Foundation’s Trustees (“the Grants Committee”). The Grants Committee will consist of a minimum of 3 key Foundation personnel.
Authorised Purpose
2. Grants will only be made in accordance with the Cuesports Foundation’s Authorised Purpose. The Foundation’s Authorised Purpose is set out in full in the attached schedule.
Funding Priority
3. The Foundation when in a situation where the funds available for distribution are less than the applications for funding received, the applications shall be dealt with in the following order/priority:
  1. Funding applications to assist with the promotion and development of amateur Cue Sports;
  2. Funding applications to assist with the promotion and development of amateur Soccer;
  3. Funding applications to assist with the promotion and development of other amateur sports in New Zealand; and
  4. Educational grants and funding to assist non profit social service or welfare agencies in New Zealand.
4. Funding will not be given for the following:
  1. Retrospective costs;
  2. Activities which result in commercial gain;
  3. Individuals;
  4. Professional sports persons;
  5. Political purposes;
  6. Costs associated with social functions;
  7. "After Match" functions; and
  8. Prizes for sporting events, except trophies or modest non-cash prizes for use in genuine community sporting events.
5. The Grant Committee will not make a grant to any organisation who has previously received a grant, but has not spent these funds, or returned the relevant audit documentation to the Foundation.
Grant Forms
6. Applications may only be considered if they are submitted on the Foundation’s Grant Application Form and the form is correctly completed.
7. From 1 July 2005 grants will not be approved unless the application form includes:
  1. the applicant's name and contact details;
  2. the purpose of the applicant and the name and contact details (including a street address) of a contact person;
  3. specific reasons for the grant application;
  4. Separate sheet with club/association/organisation header, with resolution to apply for funding, certified as true and correct with the original signature of your organisations Secretary;
  5. the total amount of money sought (if this is $10,000.00 or over a copy of the club/organisation/associations Year End Financial Statements MUST be included);
  6. evidence supporting the total amount sought (for example, competitive quotes for goods or services to be paid for by the grant);
  7. whether the applicant has applied for funds for the same specific purpose from another source;
  8. whether the applicant is registered for GST and, if so, its GST number;
  9. the applicant's bank account details;
  10. a declaration by 2 representatives of the applicant confirming that -
    1. the information provided in the application form is true and correct to the best of their knowledge; and
    2. they have the authority to make the application on behalf of the applicant; or
  11. the application form must include space for the Foundation to record:
    1. the amount approved;
    2. the date of the approval;
    3. the cheque number or details of the direct debit;
    4. the grant number; and
    5. the signature of the Foundation’s officer.

Competitive Quotes

8. Grant applications will not be approved unless they are supported by competitive quotes or other evidence that the amount applied for by the applicant is appropriate.
Double Funding
9. Where information is obtained by the Grants Committee indicating that a grant recipient has received funding from another source for the same purpose, the Grants Committee will take reasonable steps to obtain a return of the money from the grant recipient.
Adherence to Grant Purpose
10. Grants will be made on the condition that they are only to be used for the purpose that they were applied for.
Payments
11. Grants will be paid directly to the grant recipient.
Reasons
12. Grant applicants will be provided with reasons for the Grant Committee’s decision if the Grant Committee decides to decline a grant application.
Grant Promises Prohibited
13. Agreements promising to provide grants to potential grant recipients from proceeds that have not yet been generated will not be entered into.
Distribution Timing
14. A substantial portion of the net proceeds received during a financial year will be distributed to the community for Authorised Purposes, on at least, a quarterly basis.
15. All net proceeds received during a financial year will be distributed to the community for Authorised Purposes within three months following the end of that financial year.
Conflict of Interest
16. A person involved in any site operated by the Cuesports Foundation shall not be involved whatsoever in relation to the grants process.
17. No grant shall be made where a Trustee personally benefits or a close family member of the Trustee benefits directly from the grant.
18. If the Trustee is a member of any club or organisation or has a close family member associated with the club or organisation, the Trustee shall declare the interest, that interest be recorded in the Minutes and the Trustee shall stand down from the decision in relation to the grant to that particular club or organisation.
Record Keeping
19. The following records shall be kept:
  1. A list of all applications for funding received;
  2. The date each grant was made;
  3. The name of the grant recipient;
  4. The specific purpose of the grant;
  5. The amount of the grant; and
  6. The cheque number or direct debit transaction details.

What is an Authorised Purpose?

An authorised purpose is an event, project, activity or item that qualifies for funding. Authorised purposes are the set of rules under which trusts operate, so that they are of benefit to the community and do not result in commercial or personal gain. These documents are individual from trust to trust, so be sure to familiarise yourself with them before submitting your funding application.

What is a bona fide sport?

A bona fide sport is a sporting activity, school, youth organisation or club which is affiliated to a regional and national body and has genuine standards and rules, which plays or meets on a regular basis as part of a significant competition.
This definition excludes sporting activities or clubs which are social in nature. For example, according to the above definition, social games between pub patrons would not be regarded as a bona fide sporting event.

Can an individual apply for a grant?

No, any application must come from a club or non-profit body. The application may however be for an individual to compete or participate in an event.

How do you define personal gain?

A grant may not result in any personal or commercial gain to the grant applicant, a site operator, or any other party (other than incidental gain). This means a material benefit (in money, goods or equivalent) to business interests or individual(s).

Will the Cuesports Foundation consider an application after the event has taken place or after items have been purchased?

No, grants must be approved before the purchase or event.

How is the grant paid?

Grants are direct credited into the applicant's bank account.

What about GST?

The allocation of funds is made by the Cuesports Foundation and is an unconditional gift. No portion is claimed as a deduction for Goods and Services Tax paid. If an applicant is GST registered, only the GST exclusive amount can be funded.

There is one thing that I will say about Cuesports New Zealand, at least they are honest when they state, on their website...

When Cuesports Foundation Limited is in a situation where the funds available for distribution are less than the applications for funding received, the applications shall be dealt with in the following order/priority:
  1. Funding applications to assist with the promotion and development of amateur cue sports;
  2. Funding applications to assist with the promotion and development of amateur soccer;
  3. Funding applications to assist with the promotion and development of other amateur sports in New Zealand; and
  4. Educational grants and funding to assist non profit social service or welfare agencies in New Zealand
Number 2. That amateur soccer is high up on the list of funding priorities after themselves of course. Number 4. Well, I am of the opinion that a country requires a healthy and wise population so they can participate in Casual or Organised Sport i.e. amateur soccer.

My name is Siena. I do have a question to ask. Does Cuesports approve  grants to Foundations if the organisation that has set it up has invested money and also in their financial accounts at the end of the financial year have posted a good sized surplus?

I see a particular sport organisation, the foundation they have set-up has had a grant approved under: Grants Approved April 2010 - March 2011 (Previous Year's Undistributed Funds).

Sorry I am not entirely sure the questionyou are asking or reason.

Having ‘no funds’ in the bankis not a criteria of us giving a grant.  We do review financial accountshowever, there may be many reasons organisations invest or put money on termdeposit – for instance they have a capital project they a preparing foretc.

I read New Zealand Football's Annual 2010 report and the President in his report about "The New Zealand Football Foundation, " The Foundation was created initially with responsibility for managing the $4 million given to New Zealand Football for qualifying for the 2010 World Cup". Thats fine. Also, "  These FIFA qualification funds are the foundation to which New Zealand football supporters and charitable donors (such as Cuesports I am assumming), can add their own contributions.

"The Football Foundation is partnering with skilled advisors to provide investment advice and expertise as well as general day-to-day management of the Fund account". My question is will these skilled advisors charged with providing their expert investment advice as well as those from the Football Foundation in the general day-to-day management of the Fund account be the ones to actually benefit financially from the Foundation? - Their Expert investment advice consultation fees no doubt will cost an arm a leg and a header into the back of the net...I am being funny Karyn.

"The Football Foundation was created to acquire and manage funds for New Zealand Football and to provide the long-term financial support needed to grow football in New Zealand. This growth plan includes building the profile of the game, encouraging participation, and improving facilities and training for all New Zealanders, especially youth".

Its especially youth, that has me concerned. I made a formal complaint to the world governing body FIFA against NZF's chairman Frank van Hattum in respect of the threat of legal action he proposed and he along with the chairwoman of Central Football (an arm Broken one at that of NZF),Johanna Woodward sent a co-signed letter to schools and clubs in Taranaki and my second complaint though not relevant to you, was about van Hattum leaving the "door ajar" for disgraced coach Steve Cain to return to NZF in a coaching position at some later stage.

My complaint centred on the breakaway Taranaki Soccer Group Under 10's, who were threatened by NZF chairman and Central Football that Taranaki Soccer comes under. Under the UN Convention on the Rights of the Child - These kids have rights not to be impeded or to be threatened with legal action under various articles of the Convention.

Central Football had no programme for them and NZF still expected these parents to pay their affiliation fees...for what! after a year long battle there was still no compromises made and it should have been dealt with in a reasonable and amicable manner as it is about "Youth" playing soccer..They started their own soccer group and it is more cost effective for them all and the main thing is that the kids are happy and playing soccer.

You granted that foundation $36,142.58. Who will benefit by it? certainly not the Taranaki Under10's, they are out from under the umbrella of Central Football (NZF).

I have received communications back from FIFA and I did e-mail NZF about my complaints and that FIFA have responded...They still have not replied, but you have and I sent theirs the other day.

I also have communications from the Taranaki Soccer Group and a parent who was running a soccer team but became frustrated and took their son to rugby, where he now gets the support and is happy.

Hello.

I am well aware of that, however the common denominator of both is the chairman of NZF Frank van Hattum (who I might add has on numerous occasions violated the NZF's Code of Ethics and NZF's Disciplinary Code), and this Football Foundation is set-up to help develop YOUTH from all of New Zealand (allegedly), not bully via a threat of legal action against a certain sector of New Zealand Youth, namely under-10's.

You grant money to a foundation, whose main ARM NZF has a big surplus and yet you decline those more deserving and who are struggling within New Zealand Sports at the grassroots level.

I don't believe for a moment that the grant you approved to them will go to benefit the Youth of Aotearoa, it will go to line the pockets of those so-called investment advisors and to pay for the management of the day-today running of the foundation.

I shall post on my facebook page and twitter page all your grants and those who were declined as well, its called being transparent in fact I shall post your e-mailed replies as well.

Swimming New Zealand chief executive Mike Byrne says his organisation now bypasses the Water Safety Education Foundation when it comes to funding applications.

With child drowning on the rise, why is the foundation charged with teaching water safety giving millions to other sports? 

A LEARN to swim programme for primary school kids. Equipment for young children to learn surf-safety skills. An awards evening to celebrate volunteer swim coaches.
All causes that the Water Safety Education Foundation didn't think were worthy of its funding support.
And as child drowning statistics climb again, the foundation is instead happily pouring millions of dollars into semi-professional soccer and basketball clubs – and there are now calls for the donations and water safety funding to be investigated by the government.
"You see them advertising on television every summer about saving Kiwi kids from drowning, and then you think about how [money is distributed to non-water-based activities] and it's frustrating," says one source.
The foundation proudly claims it develops/promotes new, and "enhances existing, water safety education projects and programmes, in order that everyone in New Zealand will have the water safe attitudes, skills and behaviour to use and enjoy the environment safely".
The foundation's grants (it paid out almost $2.2 million last year), come from poker machines installed in nine pubs around New Zealand, and the foundation says its secondary aim is to return money to those communities.
But directly across the street from three of those nine pubs is the Hutt Central School.
And when the school's fundraising committee began seeking grants to pay for its learn-to-swim programme, it seemed obvious to apply to Water Safety.
The school followed the right process, finding two different quotes for the coaching and pool hire (the school can no longer afford its own pool). But in response, it received a form letter declining the application. "The committee were very surprised they had been unsuccessful," says principal Martyn Dowman. "They thought that was what the fund had been set up for."
Water Safe Auckland has had three applications fail over the past three years – for a "Safe Summer" scheme, a learn-to-swim programme, and then to send two staff, leading researchers in the field, to present papers at an international convention in Vietnam, on drowning.
Chief executive Sandy Harrop figured the foundation had its reasons for saying no, until she read a Sunday Star-Times story three weeks ago explaining where the foundation was putting its money instead.
"As your last article highlighted, there are a number of organisations you may see that... possibly don't fit with what the public would see as fitting with water safety education," she says.
"It is disappointing when good, legitimate applications from water-related causes are turned down, when they call themselves the Water Safety Education Foundation."

Lyall Bay Surf Life Saving Club wanted funding to buy equipment to teach surf skills. Chairman Marilyn Moffatt had never heard of the foundation before, but lodged her grant thinking her club was also the right fit.
Surf Life Saving New Zealand's Brett Sullivan is aware that surf clubs have struggled to secure funding from the foundation.
"There are some questionable philosophies and logic in the way the foundation distributes funds. It's called a Water Safety Education Foundation, and at the end of the day, they've distributed funds to non-water safety organisations. It hasn't gone unnoticed."

And Swimming New Zealand chief executive Mike Byrne says the organisation doesn't even bother applying to Water Safety any more after, most recently, being turned down for funding to cover for its annual awards.
"I have had informal conversations with the Water Safety Education Foundation and often we get discouraged from applying," he says.
Of course, like any trust, there are always more applications than there is money available. And the foundation does give a substantial annual donation to Water Safety New Zealand, a national umbrella organisation for water-based bodies such as Coastguard and Surf Lifesaving. Water Safety NZ shares offices and even staff with the foundation, but denies any conflict of interest.
But the real controversy is over where the rest of the cash goes.
It's time those practices stopped, says Byrne. "I would call for a national review of how learn-to-swim activity is funded in New Zealand," he says. "Where is all the income coming from? Who is controlling that income? And where is it being delivered to? The Department of Internal affairs should carry out the review.
"It is pretty disappointing to see swimming clubs in the areas of those pubs not being supported by a trust which has the specific purpose of furthering swimming and water safety education. It is absolutely frustrating because we know that about 80% of the kids in New Zealand, if they are going to learn to swim, the only chance they get is at primary school."
THOSE FUNDING decisions seem less bizarre when the relationships surrounding them is unravelled.
It's worth pointing out that the Gaming Act explicitly forbids pub landlords from having any influence over who receives pokie grants. The landlords have already been paid for having the machines on their premises. The decision on who gets funding should be an entirely independent decision – one made on merit.
But the Star-Times has found issues with five of the nine bars hosting the machines that provide the money for the foundation to distribute. In each case, we have unearthed a series of relationships which raise serious questions about the funding process and how decisions are made (see "Where the money went... and why", left).
Foundation chairman Alan Warner simply refused to discuss those grant decisions, saying they were "not really open for public discussion", but insisted it was a "very robust" process. As a small trust, he said, the foundation had to target its money and chose to keep it within the communities where it was raised.
Alan Muir, executive director of both the foundation and Water Safety NZ, adds: "Quite simply, the trust... would rather put something into a community that has lasting benefits than a shotgun approach. We want something worthy of continual support."
Warner made the startling admission that the foundation does not want to run gaming machines and sees them as a necessary evil.
"We are providing money for our kids to be able to swim and survive... we would prefer not to be in gaming, but given the passion we have...for our mission, we get no government funding whatsoever and limited money from lotteries, ACC is negligible, so there is nowhere else to get funds.
"We would not be in gaming but [if we were not] we are going to see an increased drowning toll in this country."
In January 2010, in response to questions from the Sunday Star-Times, Department of Internal Affairs said it was auditing the trust, and "investigating" the grants process for conflicts of interest and any possible "unlawful involvement of key persons... it is too early to reach any conclusions".
That audit report, released last May, criticised the foundation's excessive administrative costs, but didn't dip a toe into investigating its grants, saying these were the subject of separate investigations.
Last month, in response to another inquiry, the department said Water Safety was making grants which matched its authorised purpose, which was to give grants to its local communities. The department said an investigation into "possible conflicts of interest" around the Lower Hutt football club was "unfinished".
THERE'S A second storm around the activities of Water Safety. The foundation acts as gatekeeper for applications to the Lottery Grants Board, which awards funds raised from other forms of gambling. Each year, Water Safety's project review team assesses all applications from its 36 member organisations – such as water-sports associations, Coastguard and Surfing New Zealand – and submit one combined pitch for lottery money.
Muir says Water Safety's members decide where the money is allocated, by agreeing funding guidelines, although the project review team which prioritises the funding bids is actually board-appointed.
But of the $2.64m Water Safety was awarded in 2008, it paid out only $1.64m, retaining the rest for its own projects. Water Safe Auckland's Harrop asks: "Is there not a conflict of interest when they are the primary recipients of that funding, and you have to ask, are the government comfortable with that set-up?"
The government says it is. In a statement, the department says the bulk-funding arrangement with the lottery board is tacitly accepted by Water Safety's members when they accept Water Safety's constitution, and points to the independence of Water Safety's project review team which "gives [lotteries] a co-ordinated view of applications from the sector as a whole; however it does not prohibit individual applications".
The Star-Times understands that another member body, Safe Kids – a Starship hospital-run child injury prevention programme – is also frustrated by this channelling of funds, but director Ann Weaver declined to comment. Surf Lifesaving was also reticent, but suggested it, too, would like improvements to the system.
Swimming New Zealand is so frustrated by being denied a share of that lotteries money that this year it circumvented Water Safety and made a direct application.
"The Lotteries Grants board does a fantastic job but in the past we haven't been able to access money from them," Byrne says. "This year, we have applied directly to the Lotteries Grants board. We are optimistic that they will see the strength and values of our programmes and support us directly."
But Muir says independent research found an 85% satisfaction rate among Water Safety's stakeholders.
He adds: "As with anyone, there is always someone within the family who doesn't feel the sav is slicing their way."
That seems a clear allusion to Swimming New Zealand. Byrne says one reason for his organisation's funding struggle may be what he claims is Water Safety's decision to set up learn-to-swim programmes in direct competition with Swimming New Zealand's – which have trained 1200 primary school teachers and helped 50,000 children in the past five months alone.
"It's not a very smart use of public money, I don't think," says Byrne.
"They will probably tell you, if you ring them, that the Swimming New Zealand programme is crap. But we obviously wouldn't agree with that."
Muir says Byrne's assertion is simply not true, that Water Safety is simply working with regional sports trusts to identify children who aren't being taught to swim and finding providers to teach them. Water Safety pumps $4m a year into learn to swim. It found that only 21-23% of Otago under-12s could swim 200 metres but with the foundation's help, the figure was 60% after a year.
Warner points to Swimming New Zealand's own internal issues, including a highly critical Sparc report issued last week, and says Water Safety has, in the past, bailed Swimming New Zealand out financially.
And Muir says: "We've provided Swimming New Zealand over many years with funding to do professional development – that is, teaching the teachers – and it is fair to say that, through independent evaluations, it has at times come up as being ineffective."
He adds that the foundation has "struggled to get information" from Swimming New Zealand about its programmes, and when asked if the relationship had broken down, he says: "We've been attempting to try and work better with them for a period of time."
Water Safety has some impressive statistics to show that although the number of drownings has risen again of late, the long-term trend is down.
The foundation has played a part in making it safer for Kiwis to go into the water. So why would an organisation which does so much good, tarnish its reputation with unsavoury poker machine deals? Swimming New Zealand aren't the only ones asking why.

(They are no longer a part of Central Football...the BROKEN ARM of New Zealand Football Federation) All this Affiliation money that parents pay for their children, where does it go to and what is it spent on?
